General policy on the protection of personal data within the WEKA Group in France

In accordance with our philosophy, the protection of your personal data is essential to us and we wish to inform you through this general policy on the protection of personal data ("Personal Data Protection Policy") of how we collect and process your personal data.

In the Personal Data Protection Policy, unless otherwise stated, the following words and expressions have the meanings indicated below:

Intermediate Archiving: : means the isolation by a logical (management of access rights and authorisations limited to a specific service) and/or physical separation of Personal Data which still present an administrative interest for Weka France.

CNIL : refers to the Commission Nationale de l'Informatique et des Libertés.

Personal Data : any information relating directly or indirectly to you as a natural person.

Entity : entity of WEKA France with which you have subscribed/plan to subscribe to a Product and/or Service and which implements Data Processing concerning you.

Products : documentary or informative products, in particular works, publications, fact sheets, updates, in paper or digital format published or distributed by WEKA France.

Regulation : refers to Law n°78-17 of 6 January 1978 relating to information technology, files and liberties as amended, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (hereafter "RGPD") as well as any regulations in force concerning the protection of Personal Data.

Services : vocational training, advice and support services, software solutions, any documentary service by telephone, service offering access to community spaces, employment-related content services.

Site : refers to the websites published by WEKA France.

Terminal : refers to the hardware equipment (computer, tablet, smartphone, telephone) that you use to consult or view the Site.

Processing : means collecting, recording, organising, structuring, storing, adapting, or modifying, retrieving, consulting, using or otherwise making available, linking or interconnecting, limiting, erasing and destroying.

WEKA France : designates individually all the Entity(ies) of the WEKA France group including, to date, Editions WEKA SAS, Editions TISSOT SAS, Editions TI. SAS, COMUNDI SAS, CMT SAS, Lexagri SAS and WEKA Services SARL.

These definitions are capitalized and are understood in both singular and plural.


1. Scope of the Personal Data Protection Policy

The Policy on the protection of personal data applies to all Sites, Products and Services published and distributed by WEKA France.

Consequently, the use of a Site or the subscription of Products and Services published and distributed by WEKA France implies that you have accepted all the terms of the Personal Data Protection Policy, and therefore the collection, use and transfer of Personal Data concerning you.

WEKA France collects and processes, in particular, your surname, first name, your position within the organisation and the department to which you belong, your business telephone number, your business e-mail address and, for community areas and employment-related services, your personal or professional contact details according to your choice, as well as your CV if you so wish.

WEKA France will not collect any Personal Data without first informing you of the use that will be made of it.

In addition, cookies, i.e. small text files that record certain information in order to facilitate your browsing experience, are deposited on your Device when you browse the Site.

5. Retention period of Personal Data

Your identification data is kept for commercial prospecting purposes for a maximum of three (3) years from the date of the last performance of the service / delivery of products or the last "active" contact with the Entity (example of active contact: opening a link (click) from an email).

In the particular case of the Community Areas, personal data is kept for the entire duration of the existence of the member's account and for a maximum period of one year after the account is closed.

In the event of legal proceedings of any nature whatsoever, for example with regard to the administration, your Personal Data as well as all information, documents and materials containing Personal Data may be kept for the duration of the proceedings, including for a period longer than that indicated above.

The other data, and in particular those relating to your orders, are subject to Intermediate Archiving for the periods of legal or regulatory prescription.

WEKA France undertakes to delete Personal Data from its databases at the end of this period or to make them anonymous.

In addition, your Personal Data collected through the use of Cookies is only kept for a period of thirteen (13) months from the date of collection of such Data.


6. Recipients of your Personal Data

WEKA France never passes on your Personal Data to third parties who may use them for their own purposes, in particular for commercial and/or direct advertising purposes, without your express consent.

WEKA France takes the necessary precautions, taking into account the state of knowledge, the costs of implementation and the nature, scope, context and purposes of the Processing as well as the probability of each risk, in order to preserve the security and confidentiality of the Personal Data that you communicate to us and in particular to prevent them from being distorted, damaged or communicated to third parties (unless you have given your consent).

Consequently, WEKA France implements all technical, logical, physical and organisational measures to guarantee a level of security appropriate to the risk and to prevent any loss, alteration, disclosure of Personal Data or access to unauthorised third parties.

However, given the intrinsic characteristics of the Internet, not all information transmission over the Internet is completely secure. The Personal Data transmitted to WEKA France is subject to measures that cannot prevent all risks of misappropriation and/or piracy. WEKA France cannot guarantee the protection of your Personal Data from the risks inherent in this context.

In case of violation of Personal Data and in accordance with the Regulations, WEKA France undertakes to notify the CNIL.


9. Personal Data Transfers

The Data collected by WEKA France may, for the purposes mentioned above, be transferred to a country outside the European Union that has been subject to a decision of adequacy by the European Commission, only to American companies that are self-certified under the Privacy Shield agreement and have been previously registered in the register kept by the American administration for this purpose, and only to a country outside the European Union that is not subject to a decision of adequacy by the European Commission, subject to having provided appropriate guarantees in accordance with the GSPD.


10. Your Rights

These directives may designate a person in charge of their execution; failing this, your heirs will be designated.
  • The right to limit processing : the right to request that certain Personal Data not be retained for future processing.
  • The right to erasure : in the cases covered by the Regulation, the right to obtain the erasure of Personal Data.
  • A right to the portability of your Personal Data : the right to obtain, if necessary, from WEKA France the transmission of its Data to another data controller.
